Port of entry doesn't matter. You can leave from JFK and come back through California. It totally depends on your airlines and the route you choose. I have done it many times.

Now because all embassies and consulates required to use PIMS to verify your H1B status... sometimes takes several weeks to get the passport stamped. In my case takes 3 weeks after interview to get my passport back (embassy at Lima, Peru).
So beware of the timing

I came to US on H4, 3 years ago. Later I took my H1B with a recruiter and got it with I-94. It was valid up to 2007 oct. But I couldn't take up any work due to some problems. Recently I went to India and came back. At the port of entry I got new I-94 with H4 stamping. Means My H1 Is not valid now ? In this case, is there any way to apply for change of status again as my H1 is valid up to 2007. Or else do I need to apply for my new H1B again ? Pl. any one clarify.

Basically I came here to earn some money and to have some good life ( cleaning my bathroom myself -- lol )
The way things are going here in US with Jobs / Economy overall thinking if it is worth to live here and worth to get a US Passport or to keep renewing GC.
I know it all depends on each indivisual perspective and views.. but taught of looking other views on this.

The question should be when is China going to figure out an alternative business model other than depressing currency and exporting to US.
Till that time US can print as much as they want and stick it to the a**es of people who buy us treasuries.

In my opinion,
Once a person starts working on EAD, his H1 status becomes void. I have read in forum that people still switch from EAD to H1, but I am not entirely sure on that one.
But here is what your friend need to do:
All who are planning to use AC21 or already switched job using AC21 (using EAD). Following is very important:
If you think you are immune, think twice, especially if you are making an investment (American Dream) by buying house, please read the following, help keep your dream intact....

I have PD which is current (Jun 03 EB2 India), a RD which is current (Jun 05! yes VSC transfer to TSC in Apr 07). In the last week of Nov 07 got a simple RFE (medical RFE wherein the doc forgot to check one box), which was replied promptly and got confirmation from USCIS that they got the response.
Have been following up with USCIS (service request, POJ-TSC from April 7th). Got a soft LUD today (04/22/2008). does it mean anything ?
It means you are on your way to Greenland very soon!

Hi,Advise please!
1)I got H1B visa stamp until June 30,2007. Sampe company (Hospital), I got extension approval notice until July 30,2007 (i.e 30 days).
2) Hospital applied for New H1B (Change of employer) from July 31st,2007 until June 30,2010.
Can i go for stamping in June (OR) I have to wait for until July 30,2007.

You can find out by calling USCIS. There is thread here teaching tricks to get to talk to a immigration/field officer. If you can do that, you can ask him/her, and may get the answer.
By saying they wouldn't adjudicate your case becase its PD is not current, I meant they wouldn't approve your case. But they will look at your case. If something is wrong, they'll correct it or send you a RFE, both of which will result in updates. If everything is all right but only your PD is not current, they will "put in suspense" your case, which will result in an update too, and send your case to some on hold shelf. When your PD is current, they'll approve your case.

i don't believe there can be any guarantee against getting RFE or NOID. You can take precautions by following the regulations and yes having a job/job title in the same or similar occupations.
There is a lot of guidance about what constitutes "same or similar"... from USCIS
There are labor codes for every position/occupation in the Dept. of Labor...make sure yours falls within the same as directed by the USCIS guidance.

Here is one last scenario ( perhaps that is why all attorneys are saying - 'continue with your filings and go on with your life' AND all old saws all good old folks at IV might say 'I told you so'). So, not to be let out, here is my take on things to unfold tomorrow:
Why did they wait till Jul 2?
They will release the Aug VB tomorrow. In which they will retrogress most or all categories to 'U'.
They will enforce the 'DMV office rule'. All who have filed on the basis of Jul VB, will be receipted, may be finger printed but AOS adjudicated and GCs issued as dates become current.
Good night and good luck to all, particularly to those '599 (174 members and 425 guests)'
Ok Guys enough "PREDECTIONS" now go to bed.
Only the coming days will tell us what is going on and what will happen. Everything else is just hear-say.
Go to sleep and remember that we DO have day jobs.

um...looks gritty? u talking about the 'rays', rite? i made it by drawing the lines and then radial blurring it...i used the good quality, maybe i should use the best quality next time :)
i have made some changes, including removing the words in the upperleft..but i can't change the flare cos i don't want to do it again :smirk: (took quite awhile ;))

Is there a RISK to file 2 separate petitions (H4 Extension and H1) in the same time frame?
If yes, what's the option?
