All,
I am currently unemployed and my spouse needs to travel to Mumbai urgently. Our AP is valid through November 30, 2009. Will there be any issues for my wife when she comes back - possibly because of my current status. Wife is employed (with a different company)& the EAD/AP was filed by my last employer. My understanding is that state in which you work you need to pay the taxes for that state. And I believe sometime in GC interview they ask for tax papers , during that time it should not create problems.
When you are not staying in that state why do you need to pay the tax.

Hi,
I got a dream job offer and I have not yet applied for OPT. I have not graduated from school and that's why I applied for CPT.
I just want to know can I work on CPT till my OPT arrives? Also would it be of concern to my employer that I am working on CPT as long as I am eligible to work legally full time? Is that something I should intimate my employer about before joining?
I would appreciate if someone can reply really soon.

I am in a worst scenario , just changed a job couple of months ago. I have labor and I-140 approved from Company A. I have even paid $6000 to company A to sponsor my GC and $5500 for a visa transfer. After joining company B i didn't start labor again. Begging Company A to give an employement letter , they have even cancelled my H1b visa so I can't join them back unless i pay H1b visa transfer fee and a pay-cut. Wondering if it is even worth it ?

You are not the primary, right? Your job has nothing to do with the GC case. So you can do whatever regarding your job.

Employers must complete Form I-9 for all newly hired employees to verify their identity and authorization to work in the United States. If you have a receipt as proof that an extension application was filed on your behalf before expiration of your H1 then you have 240 days starting from the day your visa expires before you should get an extension. You will be out of status if your case is not resolved in the 240 days deadline. I cannot comment on the implications of missing out on a deadline for responding to the RFE.

There will be a great chance that my parent company will close down my current company after I'm transferred to them. I don't think my current employee will withdraw my I-140 case in the future. Hopefully that I-140 will go thru so I can use its PD for my future PERM/I-140 application.

The question is when.
Before or after the fall elections.
The current thinking is somehting will pass in the senate. Most likely with some sort of temporary worker status for the illegals.
If it offers a path to citizenship for the illegals then it will die in congress, if not then it stands a chance in conference.
If there is deadlock then this issue will be pushed to until after the elections.
That's my take on things.
Did you guys see Sen Frist on CNN wolf Blitzer show? Likewise that was the view of Sen Grassley.
Sad for us we are stuck in this politics.

H1B LUDs may be due to PIMS data collection, I heard most of the H1Bs approved after Jan 2004 had LUDs and the status did not change; and 140 could be a regular system touch.

I think you should be okay. I have like 5 H1Bs ( with all the extensions). My first name has 2 words and my last name is two words. On each h1b its different. I never had any problems in stamping so far. One I stamped from India, once mexico, couple times from DC ( this service is closed now).

ok.. do you mean editing an imported object in flash as if you were workin' in swift? if so.. you can't
as I said.. you can relatively edit the swf in flash.. let's say that flash doesn't know that the object it's in 3D.. for flash that's just another shape makin' your movie bigger.
importing your movie in swft format you'll have a little more control over it.. because the swift 3D flash importer separates highlights, shadows, objects, etc. to its own layer.
just in case you don't know how to import any file go to: File � Import

I have a friend in South Asia who wants to accept credit card payments for his website. There is no way for him to link paypal or any payment gateway to his bank account. I'm in the US with an H1B and I know i'm not allowed to start a business or even have a merchant account since this qualifies as active investing.
Is there anyway I can help him? I'm not interested in making any money off of this.
I know I could open a paypal account and point it to my bank account. That way, as long as the transactions are < $20000/yr , it won't be reported to the IRS and all I have to do is pay tax on the interest from my bank account. What could be potential problems with this approach? If this is illegal, I would refrain from doing it.
Can someone suggest a better way? My friend is willing to pay part of the transaction fees to whatever service he has to use.

I am currently on H4 visa and I am planning to pursue an MBA program. If i choose to study in H4, i know i qualify for the California resident fee discount. If i change my visa to F1 for studies, would i not be eligible for the california resident discount? or would i lose the residency status?

A good lawyer is worth every penny.
You, on the other hand, should play your part by being "aware" and not blindly relying on the lawyer. Your job should be to double check documents for accuracy/correctness and asking questions to the lawyer and IV to clear doubts. Making sure the lawyer is abiding by all the immigration rules as defined by the law would be another task.
