Even if your status changed to H1 in October 2004 and you started working in November 2004 for a second employer following approval for that employer, I would say it is just 30days and would not be an issue in future GC application. Don't worry about it.

Democrats are on a dual strategy here. By backing farm labor they are trying to get the votes of the latinos. By not allowing this to wade in to other skilled jobs they are keeping their union members protected.
Democrats should be seen to be what they are. If you live in CA, you must e-mail Diane and ask her why she is discriminating against Indians, Chinese, Fillipinos etc.
By the time amendments are added the bill will be too heavy to pass in the senate and there will be no legislation passed! I am almost at the point of writing to my senators to vote against the bill!

If you indeed resign, there can be trouble..."luck factor" might pay a role.
But, I'm wondering why would you want to resign ? As long as your employer is a reasonably big one and has HR rules, you might be able to take FMLA...I think that can go for as long as 6 months. You will not get paid for a lot of it (depending on you leave balances). But, you will remain employed. And, you can work with your HR and legal folks to arrange a better alternative than resign.
Now, if your employer is a small place, then its all "it depends" thing...

Hello,
I entered this country (US) on a F1 visa. I've completed my masters and during my post-completion OPT I was offered a job by a company who filed my H1. It was approved in Nov 09 and was valid until Nov 2012. But in Apr 2010 I was laid off and since H1 doesn't have any grace period and I couldn't find an employer ready for a transfer, so I changed my status back to F1. I'm currently working for an IT consulting company (full time) at their client location. The client would like to hire me full time. But since I'm working on my CPT, and do not have a valid H1 visa is it possible that the Client can simply transfer my existing H1 or do they have to file a new H1 as my status has changed. Please suggest as I'm very Confused how to deal with this situation as I do not want to lose an opportunity. Also please do throw some light on any grey areas if present.

If you qualify for EB2 then obviously go for EB2 (as its current). If you dont have a masters and have only say 2 years of experience, then instead of wasting 3 years waiting for EB2, start a GC in EB3. Once you get past I-140 the PD becomes yours. Now whenever you jump jobs and file GC again (in EB2 say) you will get the 2008 PD. So even if EB2 retrogresses in the future, you would have saved yourplace in ht equeue.

In the last days, I have realized that we have something in common with the first Pilgrims that came to America, we also have a lot in common with all the immigrants that arrived last century to the Ellis Island, and that is the same COURAGE and values to go after our dreams giving the best of ourselves for this country and for our families.
Based on what we did this last month dont you think that we need to take action to do something to make possible an increase on the GCs quota?.
I'd like to use this forum to generate all together as a team great Ideas to show that we are a positive agent of succes for America. The idea of the flowers was marvelous but I think is time to move forward, some new ideas could be:
- Pay a TV commercial showing that we (America) need diversity, need talented Immmigrants to maintain their leadership in the world.
- Post ads in the news papers (WSJ, NY times, Washington Post etc) with the same message.
- I read the blog of Greg Siskind he is doing something great mentioning oustanding immigrants on daily basis, why dont we do the same?
- Attend all senator meetings and speech and have smart and pacific members of IV in all of them showing the message?
I THINK WE CAN DO IT, we are the owners of our future, we are the only really interested in have our GCs, I dont see the USCIS, Lou Dobbs, or USANET interested in see something positive about us.

Folks,
How long does it takes to get an Advanced Parole documents after filing I485?
Will it be safe to file I485 and AP/EAD if I am planning to go to India in next 4 or 5 months?

I gues with iin 2 months for AP. but i don't know in current scenario with lot of applications. There is no harm in filing AP & EAD with 485. Even if you get them you can use it or not choice is yours. but if you use EAD h1/H4 will be invalid and you have to come back in AP. Also if you come in AP then your H1/h4 will be invalid you have to use EAD.
I think 4-5 months is decent time to get AP. But with current volume I am not sure.

I guess Wacom advertises their tablets more vigorously than Genius? Who knows... have you compared Genius and Wacom side by side and discovered that Genius is far superior? Personally, I selected Wacom because it's the only brand that isn't obscure and I've read a number of positive things about Wacom. It's pricey but a good investment. My first Graphire paid for itself in no time and even helped me purchase my Intuos 2.

On Saturday morning, the Senate failed to advance the DREAM Act (H.R. 5281) on a vote of 55-41. Sixty votes were needed to move the bill forward procedurally and stop any filibuster. With that loss, the fight for the DREAM Act is over, at least for this Congress. Below is a summary of Greg Chen's report of this vote.
The vote tally in support of DREAM included three Republicans who crossed the aisle to join 50 Democrats and 2 Independents. Those three Rs were: Richard Lugar (IN) and Robert Bennett (UT) who had come out in support long ago and Lisa Murkowski (AK) who started signaling this week that she would vote �yes�. With their yes votes, DREAM maintained its status as a bi-partisan bill back nine years to when it was first introduced with seven Republican co-sponsors. Today, long-time DREAM champion Orrin Hatch (R-UT) failed even to show for the bill he originally sponsored in August 2001.
Unfortunately the gain of three Republicans today was not enough to make up the difference. Combined there are 58 Democrats and Independents in the Senate, and there are 42 Republicans. If all the Ds and Is voted in favor, only two Rs would have been needed to reach 60. But today 5 Democrats voted against DREAM: Baucus (MT); Hagan (NC); Nelson (NE); Pryor (AR); and Tester (MT). And one Democrat, newly elected Joe Manchin (WV) failed to show. To win on �cloture� 60 votes were needed no matter how many actually voted. Thus, a no-show counted as a �no� vote.
As the 111th Congress comes to its sputtering halt, at least on immigration, the question many are asking is whether there will be a real opportunity to bring up DREAM in the 112th. Looking forward, we face at least two enormous legislative challenges: First, the House will shift to Republican control with 242 Rs and 193 Ds. Last week the House passed DREAM on a 218-198 vote�you can bet your house we won�t muster a strong showing like that, let alone a majority, when the new session starts. Second, in the Senate, the Democrats will still have the majority but their margin of control will be 53-47 so getting the �yes� votes will also be harder in that chamber.
For many of us the source of continued inspiration has been to see all the DREAM activists walking the halls of the capitol and showing tremendous courage when they are the ones who have everything at risk. Let's keep a positive spirit for the future as the fight is not over yet.

I met with a potential client who is an illegal immigrant living in the US. She has a child who is a US citizen. The father was voluntarily deported and the mother gave him permission to take the child back to their home country to visit the grandparents. The father was supposed to make sure the child returned to the US within 3 months. It has been 6 months. If my client files an application under the Hague Convention on the Civil Aspects of International Child Abduction, will the US Government begin deportation proceedings?
